Tommy Robinson Lawyer: Judge Did Not View Evidence, Islamists Threatening Acid Attack on Tommy's Wife

The judge who rushed to send activist Tommy Robinson to jail did not even watch the full video in which he supposedly breached contempt of court laws, his lawyers have claimed.

He is currently being held in segregation for his own safety in prison, but a radical Islamic extemist has managed to deliver a message to his cell threatening to kill him and attack his wife with acid.

The message was reportedly from jailed terror supporter Sayful Islam, from Robinson's hometown of Luton, and used his spouse's full name, The Times reports.

He was sent to prison just five hours after his arrest, with court documents seen by the newspaper alleging his defence lawyer at the time had also not watched the broadcast in its entirety.

In the live broadcast to Facebook, now deleted, Robinson can clearly be heard saying he is aware of reporting restrictions, which his lawyers argue shows he was attempting to avoid breaching them.

Judges order fresh hearing into allegation of contempt against former EDL leader

Tommy Robinson, the founder of the English Defence League, is to be freed from prison after the court of appeal ordered that he should face a retrial on a contempt of court charge.

He has been held at Onley prison near Rugby after being jailed for 13 months following convictions in Leeds and Canterbury for breaching reporting restrictions.

At the court of appeal on Wednesday, the lord chief justice, Lord Burnett of Maldon, upheld the Canterbury conviction but said there should be a retrial for the Leeds case.

Robinson, the appeal court said, would be released on bail on condition that he attends the retrial before the recorder of London at a date to be fixed.

The judges had been urged to overturn contempt of court findings against Robinson, 35, whose real name is Stephen Christopher Yaxley-Lennon.

At a hearing in July, his QC, Jeremy Dein, argued that procedural "deficiencies" had given rise to "prejudice".

Dein also submitted that the sentence was "manifestly excessive" and that insufficient regard had been given to personal mitigation.

Robinson was jailed in May after he filmed people involved in a criminal trial and broadcast the footage on social media. The footage, lasting about an hour, was watched 250,000 times within hours of being posted on Facebook.

The far-right activist was given 10 months for contempt of court, which he admitted, and a further three months for breaching a previous suspended sentence.

Robinson was detained outside Leeds crown court after using social media to broadcast details of a trial that is subject to blanket reporting restrictions.

Jailing him, Judge Geoffrey Marson told Robinson it was a "serious aggravating feature" that he was encouraging others to share it and it had been shared widely.

He added: "Everyone understands the right to freedom of speech but there are responsibilities and obligations. I am not sure you appreciate the potential consequence of what you have done. People have to understand that if they breach court orders there will be very real consequences."

It was the second time Robinson had breached court orders, having narrowly avoided jail in May last year over footage he filmed during the trial of four men who were later convicted of gang-raping a teenage girl.

Jep, elikkäs tältä videolta käy ilmi Tommyn itsensä kertomana seuraavia asioita. Kun hänet siirrettiin toiseen vankilaan, jossa on paljon enemmän muslimeita, hänet laitettiin eristykseen oman turvallisuutensa takia. Syytä siirtoon ei sanottu, mutta Tommy uskoo syyn olevan juuri se, että sillä hänet saatiin laitettua eristykseen. Tommylle tuotiin ruoka selliin, hän ei voinut tietää ketkä vangit sen ovat hänelle valmistaneet, tai mitä siihen laittaneet. Ensimmäisen ruokailun jälkeen hänen selliinsä huudeltiin "piditkö ateriasta, Tommy?". Vankilassa oli vangeille jonkinlainen määräraha, jolla saavat ostaa ylimääräisiä ruokatarvikkeita ja varmaan myös hygieniatarpeita. Tommyn £12 määräraha riitti viiteen purkkiin tonnikalaa viikossa. Hän söi purkillisen tonnikalaa päivässä, ja jonkin verran hedelmiä (tuskin paljon). Tommy lähetti anomuksia, että saisi luvan ostaa enemmän ruokaa itselleen. Ei myönnetty, vaikka vankilan puolesta tiedettiin aivan varmasti miksi ei voi syödä vankilan tarjoamia aterioita.

Hän sai myös jonkinlaisia tietoja vankilaan, että hänen perhettään uhataan happoiskuilla. Eikä voinut olla varma pitävätkö tällaiset raportit paikkansa, ei ollut mitään mahdollisuutta varmistaa tietoja sellaisista lähteistä, joihin hän voi luottaa. Kun hän sai soittaa kotiin, siellä oli toisinaan poliisit paikalla, ja vaimo itki puhelimessa.

"No particulars of the contempt were formulated or put to the appellant. There was a muddle over the nature of the contempt being considered." It wasn't even spelled out what Tommy had done wrong! How can one plead guilty (or be convicted) when the offences aren't even described!

And look at this: "In both the short explanation given by the judge of the general nature of the alleged contempt and the sentencing remarks, there was reference to matters that could not [have] been a breach". As in, the judge just made it up! This is scorching!

Remember, there is a detailed criminal procedure in the UK. It simply has to be followed. And it wasn't followed in Tommy's case. Listen to this: "The failure to follow Part 48 Crim PR was more than technical." It was a fatal flaw!

I've made this point a hundred times: if the judge didn't say what Tommy did wrong, how could a guilty plea have any meaning? "There was no clarity about what the appellant was admitting or on what basis he was being sentenced." Incredible. What a rebuke from the court of appeal!

There's a concept called "mitigation" -- it's basically, any facts that could be adduced to Tommy's benefit. And Tommy had no time to make them. Here's what the court said about that...

"Further difficulties arose from the limited opportunity that counsel had to investigate mitigation. There was little else which counsel could have done within the constraints under which he was working." As in: it was the judge's fault, not Tommy's public defender lawyer!

The court of appeal was tough on that point. "The level of detail which could be provided to the court was very limited and there was no opportunity to obtain character references." That's what happens in 15-minute trials. What a disgrace that Leeds Court is in today!

And then the judges took aim at the shocking 13-month sentence. "A sense of proportion must be retained. Where a custodial term of considerable length is being imposed, it should not usually occur so quickly after the conduct which is complained of." Shame on the trial judge!

And look at this. This is how an Oxford-trained judge says "it was a stitch-up": "A sentence of committal to immediate custody had been pronounced within five hours of the conduct taking place." I think the court of appeal was outright embarrassed by Tommy's treatment. #FreeTommy

Oh and there's more! Any one of these flaws would have been enough to throw out this injustice. But the court of appeal granted them all! Here's more...

"The order at Leeds Crown Court was also erroneously drawn up to suggest the appellant had been convicted of a criminal offence rather than having been committed for contempt of court." This is no minor mistake. It's shocking in its consequence....

"Errors like this have serious consequences upon the classification of prisoners, resulting in the deprivation of privileges and release on licence." As in: Tommy's brutal incarceration, in solitary confinement, in constant threat of violence -- it was all falsely done.

One more point: "In this case, it also resulted in the erroneous imposition of a victim surcharge." Is there a single thing that judge Geoffrey Marson got right? That would be a much shorter list than his appalling errors.

I cannot think of a single thing that Tommy's lawyers argued that was rejected. other than the long-shot appeal of the 2017 contempt conviction in Canterbury. Everything the Leeds judge did was rebuked today. It truly was a stitch-up. I'm thrilled the court of appeal said so.

Jälkimmäisestä ei tosin voi olla enää täysin varma - nykyisessä erikultturillisessa uusmodernissa moniarvoisessa yhteiskunnassa.

Let's get straight to the point before we belabor the ins and outs of the Tommy Robinson story and what it all means. Israel is, and has been, supporting just about every single far-right movement in Europe who will accept its support in exchange for supporting Israel against 'radical Islam' in the Middle-East. It has created for itself any movement with the phrase 'Defense League' in it. That includes Tommy Robinson's former comrades of the EDL - English Defense League.

Israel is doing three things, following the basic 'problem-reaction-solution' formula. First of all, their influence should neither be over-estimated, nor under-estimated. There is a strategy of tension at play here, and it does not necessarily revolve around Israel, but also revolves around the US which is actually at odds with the EU. But Israel is undoubtedly gaming this whole thing.

Their goal is to create a greater Israel, as spelled out in the Yinon Plan. FRN and CSS's own Joaquin Flores' detailed analysis of the probability that Israel, especially under Likud rule (who have always championed similar) is a good start in order to understand it.

1. Israel helped in creating the problem, supported the pro-migrant policies of European governments, tying them in neatly with a general 'human rights' campaign that also includes the nominally inoffensive LGB crowd, but also the problematically normalized pedophilia and transhumanist crowd. Memes like 'Open Borders for Israel' underscored Israel's hypocrisy in having previously supported open border politics for Europe, while being one of the most racist, anti-African countries in the world, paralleling the US installed 'TNC' government in Libya in terms of anti-black brutality and racism.

Israel's global backers, incidentally, the main western banking houses, continue to support an open borders policy for Europe. The 'left' was the instrument used to publicly push this through, but the secret hand of various cheap-labor (i.e. migrant) seeking corporations whose production or service is tied to European soil has also always been a major factor. Oh and by the way, this last part is why by and large 'working class heroes' like Tommy Robinson despise 'the left' in its present incarnation. 70 years ago, someone like Robinson could have been an effective "rabble-rousing" labor party militant.

2. Now Israel is gaming and playing the reaction to this, now supporting Islamophobia in Europe. I use that term with a lot of reluctance, since enough of what is now called Islamophobia is actually simply a call for a more popular and more sane policy on questions revolving around migration, which invariably effect law, culture, language, and issues of labor. Open borders is not in the interests of most Europeans, and is also unpopular in most of Europe. It's also not in the interests of the majority of people in the Middle-East for reasons of brain drain and the like. It is therefore an undemocratic, nay, antidemocratic initiative either way you score it. At the same time Islamophobia is a real thing, but the most injurious of its consequences will not be any policy adopted inside of Europe, but what European armies, if the term 'army' will still make sense in five years, will be compelled to do in the Middle-East.

The solution Israel wants, having stoked Islamophobic reactionaries to the point of blood curdled madness, is to popularize a general EU intervention - as the French have indicated a desire to do - in the Middle-East - well, the Levant at first, in particular. This 'global war against Islam' is supposed to get Western countries to fight Israel's wars for it, to see the Suez canal in Israel's hands, as well as most of the oil fields of 'Syraq', and the Euphrates River. The Tigris and even access to the Persian Gulf would be a real bonus, but why not shoot for the stars?

So with this understanding, we can get into the particulars of Robinson and the general issue of 'free speech'.

By now not only has seemingly everyone heard of what happened to Tommy Robinson, they also have a visceral reaction to his arrest, imprisonment and sentence - based almost completely on what their already established opinion of him was before the arrest and/or what their opinion is on "the Muslim question," whether strictly in the UK or, more broadly, across western Europe or even across the entire West.

Virtually the entirety of the Left in the West along with the immigrant Muslim community applauded the whole affair, from the arrest to the sentence to the gag order on the media that was lifted only three days ago, for reasons having to do with "hate," "hate speech," "hatemongers," "Islamophobia" and so forth and so on.

And virtually the entirety of the right deemed Robinson to be a "free speech" martyr and a hero in the fight against creeping Islamization and "sharia law."

Tommy on postannut videon (oli ilmeisesti livestriimi) eilen illalla. Ensimmäinen uutinen on, että mahdollinen tulevaisuudennäkymä on kaksi vuotta vankeutta. Uusi oikeusistunto on to 27.9.2018, ja alkuperäisen syytteen (raportointikiellon rikkominen) oheen on lisätty kaksi syytettä lisää.

Ensimmäinen lisäsyyte ymmärtääkseni tulee siitä, että Tommy on lausunut julkisesti tietynlaisia mielipiteitä muslimien yliedustuksesta grooming-raiskausrikoksissa, ja tämä on totuudenvääristelyä ja varmaan Suomen oikeustermein se olisi kiihottamista kansanryhmää vastaan. (Tässä kohtaa Tommy puolustautuu sanomalla, että asiat joita hän on sanonut aiheesta, ovat sitaatteja jonkin muslimijärjestön julkaisusta.)

Toinen lisäsyyte tuli siitä, että Tommy oli "hyökännyt" syytteessä olleita muslimimiehiä vastaan kysymällä mitä mieltä he ovat tuomiosta. Näiden miesten vihamielinen reaktio (raiskausuhkauksia Tommyn äitiä ja vaimoa kohtaan) on syytteen mukaan todiste siitä, että Tommyn kysymys oli hyökkäävä.

Alkuperäiseen syytteeseen raportointikiellon rikkomisesta Tommy sanoo, että raportointikielto olisi pitänyt olla näkyvillä juttua käsittelevässä oikeustalossa, mitä se ei ollut. Ja lisäksi hän raportoi ainoastaan asioita, jotka oli tuotu esille jo muissa medioissa, jolloin raportointikielto oli jo ilman häntäkin voimaton. Hän tuo myös esille, että useimmiten raportointikiellon rikkomisesta seurauksena on sakkorangaistus, tai syytettä ei edes nosteta edes silloin, kun raportointi on todella uhannut vaarantaa oikeudenkäynnin.

Saamistaan lakineuvoista Tommy kertoo, että eräs puolustusasianajaja oli sitä mieltä, että Tommyn pitäisi "tulla vastaan", myöntää syyllisyytensä ja näin hän pääsisi saman tien vapaaksi. Tommy ei aio syyllisyyttään myöntää.

En katsonut kuin puoliväliin, joten jos joku (anyone?) katsoo kaiken ja siellä on lisää mielenkiintoista asiaa, niin saa kääntää kaikille, go right ahead!
