Korukaupan ryöstäjän ampuminen kuohuttaa puoleen ja toiseen Ranskassa

Korukauppias ampui pakenevaa ryöstäjää selkään. Puolustajien mielestä kauppiasta ei pitäisi tuomita. Koruliikeryöstöt ovat Ranskassa hyvin yleisiä.

Koruliikkeen ryöstö Nizzassa Ranskassa on aiheuttanut kovan kiistan itsepuolustuksen ja aseenkäytön rajoista. Liikkeensä ryöstäjän ampuneen miehen kohtalo puhutti keskiviikkona jopa hallitusta.

Yli 1,6 miljoonaa ihmistä on antanut hänelle tukensa sosiaalisessa mediassa. Vastustajien mielestä tapaus on vaarallinen esimerkki oman käden oikeudesta. Presidentti François Hollande varoitti keskiviikkona yksinkertaistamasta kysymystä mustavalkoiseksi vastakkainasetteluksi.

Koruliikkeen omistaja ampui viime viikolla nuorukaisen, joka oli toverinsa kanssa ryöstänyt hänen liikkeensä. Ryöstäjät olivat poistumassa paikalta skootterilla, kun korukauppias ampui toista selkään. 19-vuotias mies kuoli.

Korukauppiasta vastaan on luettu syyte murhasta, ja hänelle voidaan enimmillään langettaa elinkautinen vankeustuomio. Mies sanoo, ettei hän tähdännyt pakenijoihin, vaan yritti osua skootterin renkaaseen.

Itsepuolustusta vai ei?

Miestä puolustavien mielestä huomioon pitäisi ottaa myös se, että varkaat olivat pahoinpidelleet häntä ja pakottaneet hänet avaamaan kassakaappinsa aseella uhaten. He katsovat, että mies pitäisi vapauttaa, koska Ranskan laki sallii itsepuolustuksen.

Laintuntijoiden mukaan itsepuolustuslakia tuskin voidaan soveltaa tässä tapauksessa, koska vapauttaminen edellyttää, että ampuja on välittömässä hengenvaarassa.

Sisäministeri Manuel Valls kävi tiistaina Nizzassa vakuuttamassa kauppiaille, että hallitus suhtautuu vakavasti kaupungin synkkiin ryöstölukuihin. Korukauppiaan kohtalo pitää Vallsin mukaan jättää oikeuslaitoksen ratkaistavaksi.

– Hän on kiistämättä uhri, mutta hän on myös tappanut. Oikeuslaitos selvittäköön tosiasiat, Valls sanoi.

Nizzan pormestari, konservatiiviseen UMP-puolueeseen kuuluva Christian Estrosi, osallistui maanantaina ampujaa tukevaan mielenosoitukseen, joka keräsi tuhansia ihmisiä.

Tukea on tullut myös äärioikeistolaisesta kansallisrintamasta. Sen entinen johtaja Jean-Marie Le Pen sanoo, että hänkin olisi ollut valmis ampumaan, ja nykyinen johtaja Marine Le Pen pitää tapausta esimerkkinä kansalaisten turhautumisesta viralliseen turvallisuuskoneistoon.

Koruliikeryöstö kerran päivässä

Osa keskustelusta on kosketellut ryöstäjän taustaa.  Nuorukainen oli jäänyt kiinni 14 pikkurikoksesta. Arvostelijoiden mukaan Ranskan oikeuslaitos on liian helläkätinen.

Keskustelussa on muistutettu myös, että Ranskassa ryöstetään joka päivä yksi koruliike, ja ryöstöt ovat muuttumassa yhä röyhkeämmiksi.

Rikollisuuden lisääntyminen onkin noussut yhdeksi pääkysymyksistä Ranskan lähestyvissä paikallisvaaleissa.

A jeweller in Nice who is facing murder charges for shooting dead an armed robber in the back outside his shop last week has made public defense of his actions, telling a French broadcaster that he was the 'real victim' and blamed the robber's family for his death.Stephan Turk, the 67-year-old jeweller from the southern French city of Nice, risks spending the rest of his life behind bars if he is found guilty of " voluntary homicide" the French equivalent of first degree murder.

He is under house arrest after shooting dead Anthony Asli, who had attacked him while he robbed his shop at gunpoint last week.

Turk admits to shooting Asli in the back on September 11th as he and another robber were fleeing on a scooter with gems stolen from his shop. The driver of the scooter escaped.

The thieves had punched and kicked the jeweller before forcing him to open his safe at gunpoint, behaviour that Turk's many supporters believe should be taken into account when judging him for opening fire as they sped away.

Since then the case has sparked a debate in France about the use of force in the defense of property with many French people rallying in support of the businessman.

On Wednesday he spoke out for the first time.

"Why am I guilty?" the shop owner told Europe 1 on Wednesday, before launching into a defense. "I'm more of a victim than him. It's him who decided come to my place with weapons and assault me. He violated my rights in the shop. He took my merchandise."

Asked why he was in possession of a weapon in the first place, Turk said: "I'm a jeweller living in a very very crime-ridden area. Why do I have a weapon? To defend myself, it's very simple. Look at what is happening!"

While expressing his regret for the victim and his family, Turk said the man's father was to blame for his son's violent behavior.

"Yes, of course, I am sorry for him and for his family. He's not to blame, but his father! The young man has already been involved in 14 incidents," he told Europe 1.

"Do you know what his father told the paper? 'My son needed money.' But that's not right!"
Anthony's brother Yannick condemned the jeweller's remarks. "My brother wasn't (notorious French gangster) Mesrine! He was a little kid, like there are in many neighbourhoods. He (Turk) shouldn't be talking about him.

"He has already killed him and now he wants to slander him."

On Tuesday France's Interior Minister Manuel Valls said that while he "understands the concerns and anger of our fellow citizens", that "it is now up to justice to shed light on everything".

This desire for justice is echoed by Turk himself.

"We're waiting for justice," Turk said. "I have great confidence in justice. I'm not an upholder of the law. It's a critical situation for me and for the victim."

While politicians have, in the main, steered clear of the row, the French public have been venting their anger through social media.

A Facebook group started on Wednesday and entitled "Support for the jeweller in Nice" has exploded, gaining over 400,000 followers (at time of writing) in just the last 48 hours, and provoking thousands of comments, overwhelmingly positive towards the actions of the 67-year-old businessman.

The page's mission statement tackles head-on the thorny issue of property protection. "Self-defense isn't just about your own person, but about your livelihood, how you provide for your family."

One commenter reflected the disgust of many users with violent crime and robberies in France.

"It's always the same ones who pay –  businesspeople," they said.

"And when they defend themselves, it's they who are punished. And the thieves, if they're caught, they're freed again. Bravo – that's justice for you, always on behalf of the same people, and never for anyone honest. Well done to this man, he was right."

Many others view the incident as indicative of a breakdown in law and order in France.

"This is the sad result of impunity, of a lack of justice, and the inability of the government to provide for the safety of French citizens," said one commenter.

Another expressed, in no uncertain terms, a widespread lack of sympathy for the deceased: "He played the game, and he lost."

However, the family of the 18-year-old victim, named only as Tony, have not shied away from condemning the widespread public support for his killing.

"It's true, he did a lot of stupid things. He was a little criminal, and stole scooters," the deceased's father told local local daily Nice Matin on Wednesday.

"But Tony had the face of a child, and no child is meant to die like that. I'm not defending my son, but he was shot down like pigeon over there," he added, noting that the 18-year-old was about to become a father himself.

Tony's brother Yannick told RMC: "[The jeweller] shot him out on the street, and in the back. I don't call that legitimate self-defense."

Crime on the French Riviera has become a thorny political issue in recent months, with the government under pressure to deal with gun violence and gang wars.

Responding to a series of armed jewellery heists in Cannes this summer, as well as an escalation of gangland deaths in the nearby city of Marseille, Interior Minister Manuel Valls in August announced an increased police presence in the Côte d'Azur.

"Some 4,750 police reinforcements will be deployed throughout the [Mediterranean] coast, including 143 in Cannes and Nice," he was quoted as saying by French daily Le Monde.

Speaking on Tuesday, before the fatal shooting in Nice, the city's mayor Estrosi said: "Everywhere in France, businesspeople live with the anxiety of suffering a stick-up or an attack."

Tuohon "selitykseen" ei voi kuin todeta että "lasten" ei kuulu hankkia vielä omia lapsiaan, ja vielä vähemmän kuuluu heilua aseen kanssa korukaupassa ja hakata myyjää kunnes kassakaappi aukeaa.
