As Mario Gattiker took over the Department of Migration (FOM) in early 2012, it was regarded as margins authority and was under constant fire. Today the criticism has  largely been silenced

Mario Gattiker  early 2012 must fear much - just not envious people: "This is the most thankless job in Switzerland",  the 55-year-old heard from all sides, as he in January climbed to the executive chair of the Federal Office for Migration (FOM). The list of problems was then a meter long: They ranged from inefficient operation of the Office, demotivated staff to unruly asylum seekers, overlong process times, lots of chanceless asylumseekers from Balkan to lack of enforcement and refugee centers.

The FOM was politically under constant fire, did not come out of the negative headlines, was decried as Margins Office - incapacitated and error-prone. Chaos and sadness reigned in the asylum system . But this did not challenge Gattiker. Undeterred the FOM director at the time announced that he wanted to "make it once again a respected professional office" from being the whipping boys of the asylum policy.

Gattikers immediate measures

Today Gattiker says in interview: "We have achieved a lot." In fact: Despite continuing major problems the perception of the FOM has completely changed. Politics, cantons and municipalities that were very highly critical of the FOM a year ago, today praise the new course of action. Even the charities pull - despite differences in details - in the same direction. The criticism from the outside is almost completely silent, the lead of the Department of Migration in the ongoing restructuring of the asylum system is indisputable. How has Gattiker and his people managed this remarkable transformation?

Under great time pressure - 2012, important decisions on the asylum law revision are made - Gattiker sets immediate measures to where the criticism has been loudest and quickly visible effect can be achieved: The efficiency, the abuse and the external representation of the Office.

Productivity: Justice Minister Simonetta Sommaruga took over the failed BFM reorganization of its predecessor Eveline Widmer-Schlumpf in Febuary 2012(see box). Meanwhile, to optimize the operation,  Gattiker created flexible transition structures and distributed the load again. The great internal support facilitates the difficult task. At management level, the followers of the ousted predecessor to Gattiker-Alard du Bois-Reymond are removed. The new crew, says Gattiker on request, "has continued to set clear priorities and pursues a traceable line for employees." The effect of organizational measures: Internally peace rules again, BFM employees say. Productivity also has increased - the asylum officers do 22 percent more applications than in 2011. At the same time, the application number is increasing by 21 percent to a record level of 28 631st.

Prioritization: The FOM changes its treatment practice. The new strategy aims to combat abuse and prioritize rapid decisions on manifestly unfounded applications  - some from Tunisia, Nigeria and the Balkans. The Asylum-traveling- back and -forth is pushed to a halt by the FOM-descision to no longer accept applications from those asylum seekers who travel back and forth between Dublin states . Another immediate measure relates to the mass of  Roma who come with no prospect of asylum from Serbia, Macedonia and Bosnia-Herzegovina. The FOM cut all financial services to these asylum seekers and decide their cases in 'fast track' within 48 hours.

The immediate visible effect of this change in practice takes a lot of praise to the FOM. Politically, the office makes it in many ways: The process time is shorter, not only in cases of abuse, but also  slightly decreases. The average for all procedures in 2012 is 163 days (2011: 179 days). Thus, more cases dealt with and accommodations can be relieved quickly. One-third fewer applicants are granted asylum. The acceptance rate is drastically reduced from 21 to 11.7 percent, while the federally inspected departures increase by 45 percent. The external perception effect: The impotence paralysis that many see the asylum before is broken suddenly: "The innovative measures" Gattiker recognized today as well, "have proven to be effective and thus internally and externally to strengthen confidence in the FOM."

Communication: This is based on a new communication strategy. Its goal: To position the FOM as an action and leadership capable professional office . In 2012 not only the emissions of press releases are increased by nearly a quarter compared to 2011, the FOM especially focuses on new course content. Example asylum statistics: To compensate for the negative effect of the virtually ever-growing number of applications, the FOM focuses the pressrealeses mostly on the increasing deportations, returns and cases handeled in 2012 - and praises the rata of the success to the 48-hour practices and new Dublin practice.

Dialogue: The FOM maintains targeted intensified dialogue with external partners. Gattiker plays a key role . Even his appointment as Director of the Office opens doors previously closed - especially in the cantons. The acknowledged expert starts with widespread acceptance and great trust. Unlike his predecessor Gattiker is no career changer - and goes really well with his boss Sommaruga. He knows the area of migration from the inside out, using his good rapport with cantons, municipalities, NGOs, and foreign authorities. The office director goes out, takes the critique ,explains the situation without glossing over and making his point with consistency and determination.

Only short-term impact

All this does not fail to have the desired effect. "The positive feedback from key partners as well as the fact that the external criticism ijas veen silenced," is evidence for Gattiker, "that the FOM is now well on the way." Politically this might be true. The achieved broad consensus of the modified Dutch model (into Swiss) confirms this anyhow. Since the controversial chunk of asylum legislation reform passed through parliament the pressure has subsided. But that can change quickly. The fact is: The asylum issues were postponed last year short-term, not resolved. The intended change in the perception of the FOM has its price:

Open issues: How have the new treatment strategy and the continuing high number of applications pending let the mountain in 2012 grow by a whopping 39 percent. Well over 45 000 people today are in the asylum process. Nearly 20 000 applications are pending at first instance and 15 000 and 10 000 in foreign requests hearings. The short-term effects of prioritization strategy will fall flat, fast process time in the air, when the FOM starts processing the cases that it has  shelved. It will not be easy. Because  the influx continues unabated.

Integration: The prioritization of chanceless asylumseeker clogs the channels for genuine refugees. As it is now many of them (genuine refugees) are put on the back bench - so that their entering the labor market and integration is delayed.

Cost: The already huge asylum costs are driven to the sky in 2012, the federal government has sole responsibility for social and emergency aid for 78 million more than originally budgeted. The actual total cost of the FOM 2012 amounted to CHF 1.2 billion. By 2014, even the government expects the cost to be more than 1.4 billion. It also has to do with building up: In 2013, according to FOM 854 additional places in the Official will be  required - that's one-fifth more than in the 2011th.

Feigned glance

Hardly anyone seems to be worried at the time. Especially since Mario Gattiker again recently landed a positive surprise : The FOM has found a location in Zurich for the planned test center. This nourishes the new confidence that has become widespread among the actors of the asylum system in view of the recent proposed system change . In the background however big problems loom: The  the accommodation situation is still precarious. In addition to the 1400 seats in the reception centers the federal government currently has just over 486 places in shelters.

This means the VBS can not obtain the originally 4000 planned new places by the end of 2013 . From where the 6000 places needed for the Dutch Model will come is totally unclear. Also, enforcement measures continues to be sluggish - despite the increased migration agreements. For example, in 2012 alone almost 6,000 deportation flights had to be canceled. There is still a lack of detention sites. At the end of 2011 there were 381 detention places in Switzerland. By comparison, in 2012 the authorities ordered for 5739 failed asylum seekers to be placed in detention pending deportation. Missing today is from 500 to 700 places of detention. These are to be developed but - where and how much money the federal government has to shell out for this is of course open. Even after the turnaround in the FOM, top migration official Gattiker still has a lot of thankless tasks to do.



What's coming up in 2013 on asylum policy

In the Swiss asylum policy 2013 is another year of destiny. In the next few weeks and months a number of major decisions are up to the ongoing reorganization of the asylum procedure. So on March 19, ending the interview on the planned application of the urgent measures. This includes a prescription for the test phase for the proposed new procedures. However, if the people approves the referendum on June 9, the changes are implemented immediately. The test operation will start at the latest in early 2014.

Before April the Justice Department will send a bill for the intended procedure changes, which follows the Dutch model, for consultation. The Federal Council's message is then scheduled for late 2013. This submission represents  the completion of the three-part asylum law revision.

In addition, 2013  the highly controversial implementation of the SVP deportation initiative. Here, the Federal Council is planning to present an implemantation law in the summer .

The city of Zurich has offered space to the Federal Migration Office to build a temporary centre for up to 500 asylum seekers. The project will be a way to test cantonal and federal cooperation in implementing recent asylum law changes.
Space for the new centre has been set aside in an area in the west of Zurich. The city expects to save around SFr1 million ($1.1 million) by hosting the centre due to the fact that the federal government will take care of schooling, housing and security concerns for the asylum seekers to be housed there. Normally, such responsibilities fall to individual cantons.

At a news conference on Friday announcing the building plans, city officials along with the federal authorities said the project would be an ideal way to test new laws designed to process asylum requests more quickly. For example, the proposed centre would allow translators, medical personnel and councillors to operate out of a single location, making it easier to process cases.

The migration office would like to rent the plot of land for 15 years in order to properly develop it into a housing centre that could also last beyond the trial period if the project is successful. Building plans have yet to be finalised, but the city of Zurich has recommended constructing a "container city" out of shipping containers, much like a community that already exists in one part of Zurich.

City officials said those living in the temporary housing would be subject to strict curfews and house rules. The Duttwiler plot is currently home to city offices and an industrial site.

Current law

Recent changes to Swiss asylum law state that Switzerland no longer provides refugee status to conscientious objectors and army deserters, most notably in Eritrea. The new laws also allow for the creation of special centres for uncooperative asylum seekers already in the country and state that asylum seekers may no longer file applications at Swiss embassies abroad. The asylum law revisions will be put to a nationwide vote in June.

The legal revisions also stipulate that the government is authorised to test different procedures to speed up asylum requests, as it will now do in Zurich, and federal authorities can house asylum seekers for up to three years in accommodations without asking explicit permission from cantonal authorities.

The changes to Switzerland's asylum policy are already in effect because parliament considered them urgent and voted on them in September 2012. However, they will last until the end of September 2015, and if the Swiss people vote against the changes, they will only be in effect until September 2013.

It was also recently announced that Justice Minister Simonetta Sommaruga will visit Nigeria, the Democratic Republic of Congo and Angola imminently to discuss immigration issues and, specifically, how many rejected asylum seekers those countries are prepared to take back. She will visit Africa between February 1 and 7.

Erityisesti Pohjois-Afrikkalaiset 18-30 vuotiaat miehet aiheuttavat ongelmia. Usein he ovat "erittäin kuritottomia,"  käyvät hoitajien kimppuun eivätkä seuraa mitään sääntöjä. Urs Hofmann, Aargausta kertoo "SonntagsZeitung"ille: "Kantoni Aargaun poliisi kohtaa yhä useammin alkoholisoituneita turvapaikanhakijoita Pohjois-Afrikasta ja pienrikollisuutta turvapaikanhakijoiden majoituksessa."

Seuraus on, että liittovaltion hallituksella ja kantoneilla on edessään huomattavia lisäkustannuksia. Hans-Jürg Käserin mukaan kyse on  miljoonista, sillä monissa paikoissa ylimääräistä rahaa menee yksityisille turvallisuusalan yrityksille. Liittovaltion budjetissa on tänä vuonna budjetoitu vastaanottokeskuksiin noin 15,5 miljoonaa frangia turva-alan yrityksille. Ensi vuonna 18 miljoonaa frangia. Tämä(kasvu) johtuu ennen kaikkea siitä että turvallisuustoimet on vahvistettava keskuksissa.

Minusta näyttää siltä että monen sveitsiläisten mitta on tullut täyteen.
He kun ovat heränneet siihen että löytyy ihmisiä jotka haluavat käyttää heitä ja sveitsin järjestelmää hyväkseen.
Sveitsi on myös ollut pitkään hyvin turvallinen maa,  yhtäkkiä rikollisuus on kuitenkin kasvanut rajusti.
Tähän kaikkeen halutaan nyt puuttua ja pistää 'stoppi'.
