A teenager who posted rap lyrics which included racist language on Instagram has been found guilty of sending a grossly offensive message.

Chelsea Russell, 19, from Liverpool posted the lyric from Snap Dogg's I'm Trippin' to pay tribute to a boy who died in a road crash, a court heard.

Russell argued it was not offensive, but was handed a community order.

Prosecutors said her sentence was increased from a fine to a community order "as it was a hate crime".

She was charged after Merseyside Police were anonymously sent a screenshot of her update.

The screenshot was passed to hate crime unit PC Dominique Walker, who told the court the term was "grossly offensive" to her as a black woman and to the general community.

The Liverpool Echo reported that Russell's defence had argued the usage of the word had changed over time and it had been used by superstar rapper Jay-Z "in front of thousands of people at the Glastonbury Festival".

She was given an eight-week community order, placed on an eight-week curfew and told to pay costs of £500 and an £85 victim surcharge.

On the 23rd of April 2018 I was sentenced to an £800 fine after being found guilty of being "grossly offensive" under section 127 of the Offensive Communications Act 2003. Due to me creating a clearly comedic video where I trained my girlfriends pug to be a Nazi.

The only way for the court to secure a conviction was to willingly ignore the clear context of the video, which was explained twice, in the video itself.

This conviction will be used as an example to convict other people over the things they say and the jokes they make, it sets a standard where courts will be able to willfully ignore the context and intent of a persons words and actions in order to punish them and brand them as criminals.

This is the amount that has been quoted by my lawyer, the reason it has been quoted so high is my lawyer wishes to bring in top legal representatives to ensure that we have the highest chance of reversing the standard that this case sets, I cannot allow the 2 years of litigation I went through and having my life put on hold, to happen to anyone else.

I will be 100% transparent with these funds, all bills in regards to the case will be made publicly available.

The politician said: "I saw the messages and wrote to The Wokingham Conservatives, pointing out that I thought it was islamophobic [sic] and that they needed to deal with it.

"I demanded his resignation. He posted something along the lines of 'mass immigration has destroyed your future'."

Mark Meechan fails with attempt to overturn conviction and sentence for 'grossly offensive' YouTube video

A man who trained his girlfriend's dog to perform Nazi salutes has been refused permission to appeal against a conviction for causing "gross offence".

Mark Meechan, who blogs under the name Count Dankula, was fined £800 in April after being found guilty under the Communications Act over the video which was viewed more than 3 million times on YouTube.

It showed his girlfriend's pug raising its paw apparently in response to statements including "sieg heil" and calls to murder Jewish people.

​Meechan, a Ukip member from Coatbridge in North Lanarkshire, denied committing an offence and said he made the video to annoy his girlfriend in April 2016.

He then attempted to overturn both his conviction and sentence, but was refused leave to appeal by the Sheriff Appeal Court in Edinburgh.

A letter from the court said the appeal was "not arguable and in each of its elements is wholly misconceived".

It also dismissed arguments made by Meechan's lawyers over the judge's handling of witness evidence at Airdrie Sheriff Court in March and the meaning of "grossly offensive".

"The appeal against conviction is without merit," said the letter. "Likewise the appeal against sentence is not arguable – this was a deeply unpleasant offence in which disgraceful and utterly offensive material was very widely distributed by the appellant," it said. "This was to the considerable distress of the community in question and – just as disturbingly – to the apparent approval of a large number of persons who appear to share the appellant's racist views.

2018-10-03 Police Professional: Former sergeant awarded £95,000 after he was subjected to 'unconscious discrimination'

In May, an employment tribunal concluded that Zaheer Ahmed, a former sergeant with North Yorkshire Police, faced "unconscious" and "direct" racism due to his Pakistani ethnicity. 

The former officer, who served at the force for 23 years, had applied for a custody sergeant role twice, but was told he did not have enough experience and was not performing well.   

This week, North Yorkshire Police apologised to Mr Ahmed and agreed to pay him £95,000 "made up of compensation and a contribution towards legal costs". 

In a statement, Mr Ahmed said he has accepted that the discrimination against him was "unconscious" and he believes the force has moved on from "the days when discrimination was ignored". 

He added: "North Yorkshire Police has shown it is trying to tackle unconscious bias, and I think this is a positive step. I met some outstanding individuals while working in the force, and I am proud of my service and the contribution I made as a police officer.   

"It is vital for the police and the public that people from black and minority ethnic communities (BAME) are strongly represented in the police workforce, and given the work North Yorkshire Police is now doing to support that, I encourage people from BAME communities to serve at North Yorkshire Police."

Chief Constable Lisa Winward said: "I would like to take this opportunity to apologise publicly to Mr Ahmed for the unconscious discrimination he suffered while an officer at North Yorkshire Police, and for the handling of a historical incident where Mr Ahmed was subjected to a racial slur by a detainee in custody, that was not then properly investigated.   

"I am committed to providing a positive working environment for every member of our workforce, and to tackling discrimination wherever it is found in our organisation. As well as offering my sincere apology, I would like to give my thanks to Mr Ahmed for his service, contribution and for bringing these matters to our attention. I wish him well in his retirement. It has been well-earned."

A description of the dog fouling incident reads: 'An unknown dog has fouled outside of victim address and victim perceived this to be a racial incident.'

Another canine-related case logged as an alleged hate crime says: 'Suspect's dog barking at victim.'

On another occasion, a supposed victim of racial abuse reported that he 'believes a letter addressed to him was opened and then resealed before he had collected it from the Post Office'.

Several of the claims were over parking disputes or car crashes. One entry says: 'Unknown suspect has reversed into victim's car causing extensive damage. Victim perceives to be a hate crime as she had a poppy in front of her car.'

Another man claimed that his neighbours were parking only outside his house and were 'targeting him due to him being black'. Disputes between neighbours feature prominently. One entry says: 'Victim on hearing her neighbours in their house has put her ear up to their door to hear what they are talking about. In a conversation they have referred to her as [redacted] and made remarks of trying to get her moved out.'

Another reads: 'Witness has had parking issues with her next-door neighbour, their children apparently throw stones and balls over the garden fence. Witness has recently found a dead rat in garden and perceives this to be racist.'

On another occasion, a resident in a block of flats reported that a neighbour was racially abusing them by 'smoking heavily'.

Meanwhile, an angry father called police after his daughter lost a tennis match to complain the defeat was due to a racist umpire. 'Informant feels his daughter was subjected to racial discrimination at a tennis match where line calls went against her,' the incident log reads.

Other arguments involved unhappy customers in shops, pubs and on public transport.

They include one person who felt a bus driver had given them a 'racist look' and a woman thrown out of a pub for being 'drunk, aggressive and erratic' who told police she had been targeted 'because she is Polish'.

In a separate complaint, a pupil struggling in a swimming lesson reported his teacher for 'faith-based abuse' for speaking to him in an 'abrupt manner'.

UK police are touting artificial intelligence as a solution to the problems of modern law enforcement, reassuring naysayers that the use of "pre-crime" algorithms will be restricted to offering "counseling" to likely offenders.

Suggesting that budget cuts have rendered mere human police incapable of doing their jobs without cybernetic help, project lead Iain Donnelly claims working with an AI system will allow the force to do more with less. He insists that the National Data Analytics Solution, as it's called, will target only those individuals already known to have criminal tendencies, sniffing out likely offenders to divert them with therapeutic "interventions," including individuals who are stopped and searched but never arrested or charged.

Donnelly claims the program is not designed to "pre-emptively arrest" anyone, but to provide "support from local health or social workers," giving the example of an individual with a history of mental health problems being flagged as a likely violent offender, then contacted by social services. Given that a violent mental case would almost certainly react negatively to being contacted out of nowhere by a mysterious social worker – and that a history of mental health problems is not in itself criminal – Donnelly was wise to end his example there.

Three officers detained Kate Scottow at her home before quizzing her at a police station about an argument with an activist on Twitter over so-called 'deadnaming'.

The 38-year-old, from Hitchin, Hertfordshire, had her photograph, DNA and fingerprints taken and remains under investigation.

More than two months after her arrest on December 1, she has had neither her mobile phone or laptop returned, which she says is hampering her studies for a Masters in forensic psychology.

Writing on online forum Mumsnet, Mrs Scottow – who has also been served with a court order that bans her from referring to her accuser as a man – claimed: 'I was arrested in my home by three officers, with my autistic ten-year-old daughter and breastfed 20-month-old son present.

'I was then detained for seven hours in a cell with no sanitary products (which I said I needed) before being interviewed then later released under investigation ... I was arrested for harassment and malicious communications because I called someone out and misgendered them on Twitter.'

Confirming the arrest, Hertfordshire Police said: 'We take all reports of malicious communication seriously.'

The case is the latest where police have been accused of being heavy-handed in dealing with people who go online to debate gender issues.

Sitcom writer Graham Linehan was given a verbal harassment warning by West Yorkshire Police after transgender activist Stephanie Hayden reported him for referring to her by her previous names and pronouns on Twitter.

It was complaints by Miss Hayden that led both to the arrest of, and injunction against, Mrs Scottow.

High Court papers obtained by The Mail on Sunday detail how Mrs Scottow is accused of a 'campaign of targeted harassment' against Miss Hayden, allegedly motivated by her 'status as a transgender woman'.

The papers claim that, as a 'toxic' debate raged online over plans to allow people to 'self-ID' as another gender, Mrs Scottow tweeted 'defamatory' messages about Miss Hayden.

She is also alleged to have used accounts in two names to 'harass, defame, and publish derogatory and defamatory tweets' about Miss Hayden, including referring to her as male, stating she was 'racist, xenophobic and a crook' and mocking her as a 'fake lawyer'.

Mrs Scottow denied harassing or defaming Miss Hayden and said she holds a 'genuine and reasonable belief' that a human 'cannot practically speaking change sex', but Deputy Judge Jason Coppel QC issued an interim injunction that bans her from posting any personal information about Miss Hayden on social media, 'referencing her as a man' or linking her to her 'former male identity'.

Mrs Scottow last night declined to comment.
