Italy transfers migrants off ship, but refuses them entry (14.7.2018)

Italy transferred 451 migrants from a big fishing boat onto two border patrol vessels Saturday in the Mediterranean Sea, but the migrants' ultimate destination remained uncertain after Italy's hard-line interior minister insisted they should be sent to Malta or Libya instead.

Interior Minister Matteo Salvini, who has forced migration to the top of Europe's agenda by refusing to let rescue boats dock at Italian ports, vowed to remain firm Saturday as he created yet another standoff with hundreds of migrants stranded at sea.

Italian Premier Giuseppe Conte's office said three ideas were being considered: Redistributing the migrants among European countries, contacting Libyan authorities to arrange for their return, or keeping them on board the ships to screen them for asylum.

Both Italy and Malta refused to let the fishing boat dock. Malta said Friday it had fulfilled its obligations by monitoring the vessel to see if it needed help. Malta says the ship's crew made clear they were heading toward the Italian island of Lampedusa and eventually moved out of Maltese waters.

Salvini and his transport minister insisted Malta should have opened its ports to the ship.

Early Saturday, the migrants were taken off the boat and transferred onto a rescue vessel from the EU border patrol agency Frontex and a ship from the Italian border police.

Salvini's office said he told the Italian premier the two ships should now be directed south toward Malta "or better Libya."

Czech Prime Minister Andrej Babis tweeted that the country would not accept any of the 450 asylum seekers.

Babis called the Italian approach a "road to hell" and reiterated his stance that boats should be stopped and turned back and that migrants should be helped in their countries instead of being let into the European Union.

Viisi maata suostuu ottamaan siirtolaisia Välimeren laivoilta – 450 ihmistä odottaa pääsyä maihin Italian vesillä (16.7.2018)

Italia vaatii muita EU-maita ottamaan vastuuta siirtolaisista. Kahdesta siirtolaisia kuljettavasta aluksesta on päästetty Italiassa maihin vain hoitoa tarvitsevia ihmisiä.

Saksa, Espanja ja Portugali ovat ilmoittaneet ottavansa kukin vastaan 50 siirtolaista Italian Sisilian saaren edustalla odottavista kahdesta laivasta. Ranska ja Malta olivat ilmoittaneet lauantaina ottavansa laivoista niin ikään 50 siirtolaista kumpikin.

– Tämä on solidaarisuutta ja vastuullisuutta, jota olemme aina toivoneet Euroopalta ja nyt, Eurooppa-neuvostossa saavutettujen tulosten jälkeen, se alkaa muuttua todeksi, Italian pääministeri Giuseppe Conte kirjoitti Facebookissa sunnuntaina.

Tšekki on kuitenkin vastannut Italian pyyntöön kieltävästi ja ilmoittanut, ettei ota vastaan yhtään ihmistä laivoilta. Maan pääministeri Andrej Babis'n mukaan siirtolaisia kuljettavat alukset pitäisi käännyttää takaisin sinne mistä ne tulevat ja siirtolaisia tulisi auttaa heidän kotimaissaan.

Italia vetää tiukkaa linjaa

Italia on tuoreen populistihallituksensa tiukan maahanmuuttolinjan myötä kieltäytynyt enää päästämästä maahan Välimeren yli saapuvia siirtolaisia. Se on vaatinut muita EU-maita ojentamaan auttavansa kätensä Välimeren ylittäjille.

Yhteensä Italia on onnistunut viikonlopun aikana löytämään määränpään 250 siirtolaiselle, mutta laivoissa Sisilian edustalla on kaikkiaan noin 450 mereltä pelastettua ihmistä. He olivat lähteneet kalastusaluksella perjantaina matkaan Libyasta ja heidät pelastettiin myöhemmin kahteen EU:n raja- ja merivartiovirasto Frontexin alukseen.

Sunnuntaina kahteen laivaan toimitettiin jälleen päiväksi ruokaa ja juomaa. Laivoille vietiin mm. maitoa, mehua ja vauvojen ruokaa.

Uutistoimisto AP:n mukaan Italiassa oli päästetty maihin noin 70 ihmistä sunnuntai-iltaan mennessä. Joukossa oli esimerkiksi raskaana olevia naisia, pieniä lapsia sekä nestehukasta kärsiviä.

Italy will allow some migrants to disembark in Sicily from two ships which picked up 450 asylum seekers from an overcrowded boat, Italy's Interior Minister Matteo Salvini said on Sunday on TV channel RaiNews24.

Myös Irlanti ottaa 20. Tsekin lisäksi myös Puola, Slovakia ja Unkari kieltäytyivät ottamasta yhtään. Italialle jää näköjään loput 180.

450 pelastetuista suurin osa oli Eritreasta (291) ja Somaliasta (92). Loput pelastetuista olivat mm. Nigeriasta, Bangladeshista, Algeriasta, Libyasta, Syyriasta ja Egyptistä.

Some 128 unaccompanied minors landed at the Sicilian port of Pozzallo Sunday night as well as three accompanied minors, 44 women and 272 men, sources said Monday.
The total was 447 persons, of whom 291 from Eritrea and 92 from Somalia.
Other migrants came from Nigeria, Bangladesh, Algeria, Libya, Syria and Egypt.
Many of he migrants were said to be malnourished and suffering from scabies.
The local migrant-registration hotspot was full to overflowing.

The far-right Italian interior minister has hardened his stance against migrants by refusing for the first time to allow an EU border protection boat, supplied by Britain and carrying 176 people, to dock.

HMC Protector, waiting off the coast of Sicily, was denied permission to dock by the Italian government. Matteo Salvini, the interior minister, drew criticism from the mayor of the Sicilian port of Pozzallo, who said that the ships held suffering people and not merchandise. "What is happening is incredible," Roberto Ammatuna said. "There are people on the ships who need assistance and a suitable place for care and rest."

HMC Protector, a 50m cutter that serves in Frontex, the European Union's border agency, helped to rescue 450 migrants from a large wooden fishing boat near the Italian island of Linosa on Saturday. Another 259 migrants rescued from the wooden boat were also stranded in 36C heat in the sea near Pozzallo on the Monte Sperone, a patrol boat operated by Italy.

Mr Salvini has insisted that the migrants, mainly from Eritrea and Somalia, must be guaranteed hospitality in other European countries or be sent back to Libya, where they began their crossing.

Fifteen vulnerable adults and children have already been taken ashore for hospital treatment but 20 children stayed on board the boats, which are lying 12 miles off Sicily. They have received food and supplies to sustain them for another two days.

France, Malta and Germany agreed at the weekend to take in 50 migrants each. Giuseppe Conte, the Italian prime minister, said last night that Spain and Portugal had also each agreed to take 50 migrants, and he authorised the disembarkation of all 43 women and 14 children on board.

Spanish rescuers separately saved more than 340 migrants from the Mediterranean on Saturday.

Members of the Visegrad Group of central European countries are strongly opposed to migrant quotas. Andrej Babis, prime minister of the Czech Republic, described them yesterday as "the road towards hell". Hungary, Poland, Austria and Slovakia have also expressed reluctance to help Italy.

Mr Salvini has argued that only legally authorised migrants should be allowed into the country and that his tough line would save lives in the long run. The number of arrivals in Italy was down by 27,000 in his first six weeks in office, compared with the same period last year, Mr Salvini said in a letter to Corriere della Sera published yesterday.

Open Arms sends 2 ships to rescue migrants off Libya (17.7.2018)

The Spanish NGO Proactiva Open Arms has sent two ships to rescue migrants in distress off the Libyan coastline despite the fact that Italian ports are closed and the EU has called for "non-interference".

Open Arms has defied the closing of Italian and Maltese ports and has sent two ships toward Libya to rescue migrants in distress. It has in so doing also ignored an EU request to not interfere with operations by the Libyan Coast Guard.

Italian Interior Minister Matteo Salvini commented by saying that "let's save time. Our ports are not available. Italy has ceased to be the world's refugee camp".

Ships towards Libya

The Spanish NGO was denied access for one of its ships carrying 60 migrants by both Italian and Maltese ports early this month, forcing it to remain in the open sea for several days prior to getting permission to dock in Spain. Proactiva Open Arms has in this way made it clear that its humanitarian activities will not stop. Two of its vessels, Open Arms and the Astral yacht following it, are heading towards the Libyan search and rescue area.

"We are sailing towards a place where there are no clandestine people or delinquents, only human lives in danger. And there are too many dead bodies in the depths" of the Mediterranean already, the organization said. It added, in reference to Italy, that even "if it closes its ports, it can't put gates in the sea".

"They will see Italy on postcards," Salvini had said in announcing the closing of Italian ports even for supply stops in its crusade against NGOs, which he considers one of the main culprits of migrant landings on Italian coasts. The minister has since repeated that "let's save time, effort and money. They need to know that Italian ports are not available".

Hardline stance pays off in EU

The hardline stance taken by the Italian government, fully supported by its Maltese counterpart, has paid off within the EU. In the last EU summit, the principle that all ships operating in the Mediterranean should not interfere with the Libyan Coast Guard was agreed upon. The conclusions of the European Council sparked protest from NGOs.

Human Rights Watch called it an ugly day for Europe, underscoring that the people intercepted off the Libyan coast end up in indefinite detention and at very high risk of extreme abuse. Doctors Without Borders (MSF) asked the Italian prime minister whether this was really the Europe that we want.

Lifeline-kapteeni nousi Euroopassa otsikoihin kun hänen aluksensa juuttui kesäkuun lopulla Maltan edustalle tuotuaan sitä ennen 234 pääosin musta-afrikkalaista Eurooppaan. Reisch joutuu tämän kuun lopussa Maltalla oikeuteen. Häntä syytetään Maltan vesillä liikkumisesta ilman asianmukaista rekisteröintiä.

The Libyan navy and its coast guard have refuted the claims of the Spanish non-governmental organization, Proactiva Oppen Armas, regarding the recent events (a rescue operation carried out within Libyan waters 76 miles from the coast by Ras Jedir) (A migrant worker who had run out of the rescue boat professionally and in accordance with international standards in saving lives at sea). She was on board the German coastguard boat and was a witness to the incident. She prepared a report, in particular, to be broadcast on N-TV (RTL), one of the largest private German stations.

The Coast Guard, which saves and preserves human life, has saved more than 80,000 migrants in the past few years with simple means and difficult conditions. It is not our religion, our ethics and our behavior to leave human life at sea, and we originally came out only to save it.

All that has happened and is happening at sea is caused by human traffickers who are only interested in profit, and the presence of such irresponsible and non-governmental organizations in the region.

The Libyan Coast Guard is changing its capabilities to the utmost effort and race to save human beings and its ambitions and agenda has only the agenda of the homeland and the spirit of humanity which is part of his beliefs and literature.

Eight migrants suffocate to death in a fish truck container

8 illegal immigrants – six children, one woman and one man – were found suffocated due to inhaling fuel inside the fish freezer container, while 90 others were rescued and sent to the Zuwara seaside hospital, according to the city's security directorate.

The security directorate said the truck container was found after information was exchanged with the directorate saying a dubious parked truck was next to Mellita gas complex in the city. A patrol was immediately sent and seized the truck, inside which there were 100 immigrants including 8 dead.

"The migrants are of African, Arab, Pakistani and Bangladeshi nationalities." The statement said.

It added that investigation was underway to arrest the people behind this heinous act and bring them to justice.

They should save time and money, they will see Italian ports in a postcard". Salvini thus reiterated that he is closing Italy's ports to the ships of Catalan NGO Proactiva Opne Arms which are at the moment in the search-and-rescue area in front of Libya.

The president of the European Parliament, Antonio Tajani, said that "it is not by sending 250 migrants to partners that problems are solved. The government lacks an overall strategy, it is dealing with the issue only from the standpoint of security. Flows are blocked only with an EU strategy, not by taking hostage women and children aboard ships", Tajani commented.

On Monday, Salvini told the European Union, in a controversial statement, that Libya should be considered a "safe port" and that everyone leaving from its coasts should be taken back. EU foreign policy chief Federica Mogherini, through her spokesperson, responded saying that "no European operation of ship lands in Libya because we do NOT consider Libya a safe port". The decision of not considering Libya a safe port, added Mogherini, "is of the European court of human rights, therefore it is a purely juridical evaluation".

Salvini immediately responded saying that the "European Union wants to continue making the dirty work of smugglers easier".

Eläkkeellä oleva amiraali ja merioikeuden asiantuntija Fabio Caffio arvioi yllättyneenä EU:n kielteistä vastausta esitykseen kuljettaa siirtolaiset takaisin Libyaan vastaanottoleireihin. Il Giornalen haastattelussa hän esittää oletuksen, että Brysselin "EI" voidaan sivuuttaa Italian ja Libyan välisen bilateraalisen sopimuksen avulla.

Mikä oli ajatus?

"Itsetietoinen asenne, jolla EU ja korkea komissaari Federica Mogherini määrittelevät Libyan turvattomaksi satamaksi, on hyvin yllättävä. Kaikki tuo perustuu Euroopan ihmisoikeustuomioistuimen päätökseen tapauksessa Hirsi vuodelta 2012 (päätös, joka kieltää palauttamiset (refoulement), toim. huom.). Tämä päätös oli kuitenkin seurausta Italian hallituksen luovuttamisesta. Ja se perustui hyvin yleisiin YK:n raportteihin. Nykyisin tilanne on toinen. Gentilonin hallituksen vuonna 2017 allekirjoittama sopimus sisältää joidenkin maahanmuuttajien vastaanottokeskusten rahoittamisen. Sopimus koskee vain keskuksia, joiden valvonnan takaa Italia".

Eli Salvini on oikeassa? Voimme tehdä tämän myös ihan itse?

"Italian ja Libyan välisen ystävyyssopimuksen artikla 19, jonka sopimuksen ulkoministerimme ja Libyan ulkoministeri vahvistivat äskettäin, edellyttää yhteistyötä maahanmuuttokysymyksissä. Tämän johdosta bilateraalinen sopimus on käyttökelpoinen. Ainoa este on Libyan kansallinen ylpeys, joka ei siedä kovin hyvin ulkomaalaisten väliintuloa. Tämä ongelma voidaan kuitenkin voittaa heidän osallistumisellaan Italian rahoittamien vastaanottokeskusten toimintaan".

Tulisiko suunnitella italialaista ad hoc missiota?

"Riittää, että Mare Sicurolle annetaan aktiivisempi rooli. Mare Sicuro on Italian laivaston missio, jonka vastuulla on öljyinfrastruktuuri, sekä terrorismin ja rikollisuuden vastainen taistelu. Voidaan ajatella myös tiiviimpää yhteistyötä Mare Sicuron ja Libyan rannikkovartioston kanssa, jolle annamme tällä hetkellä vain partioveneisiin liittyvää teknistä apua. Mare Sicuro voisi tarjota libyalaisille ohjeita meripelastustoimiin. Samalla voitaisiin perustaa Gentilonin hallituksen sopimuksen mukaisia Libyan valvonnassa olevia vastaanottoleirejä, jotka Italia rahoittaa".

Ehkä voisimme kouluttaa ja opastaa valvontaa tekeviä libyalaisia yksiköitä?

"Minusta tällaista yhteistyötä ennakoitiin jo viime vuonna tehdyssä sopimuksessa ja sitä voidaan edelleen päivittää".

Mutta onko rannikkovartiosto luotettava? Ei-valtiollinen Open Arms organisaatio syyttää lasten ja naisten jättämisestä merelle?

"Monet tahot sanovat olevansa Libyan rannikkovartiostoa, mutta meidän hallituksemme katsoo rannikkovartioksi vain Libyan laivaston tai puolustusministeriön alaisuudessa toimivat yksiköt. On kiinnitettävä huomiota näihin, ei muihin. On muistettava, että tähän päivään mennessä Kansainvälisessä rikostuomioistuimessa ei ole ollut tutkinnassa yhtään tapausta, jossa joku olisi kuulunut rannikkovartiostoon".

Tänään Brysselissä keskustellaan EU:n Sophia merimissiosta, joka tuo kaikki maahanmuuttajat Italiaan. Voivatko säännöt muuttua?

"Maihinlaskupaikka tulee olemaan edelleen Italia, koska Sophian operatiiviseen suunnitelmaan on kirjoitettu outo kohta, joka on peräisin Triton-operaation ajalta. Tritonia ei kuitenkaan enää ole ja sen korvannut Themis-operaatio ei edellytä sitä, että kaikki tuodaan Italiaan. Siten myös Sophiaa tullaan muokkaamaan uuden sukupolven hotspoteilla yksittäisissä EU-maissa ja määrittämällä, että maalla, jonka lipun alla alus purjehtii, on roolinsa näiden henkilöiden lopullisen sijoituspaikan kannalta.

Koko tämä vetoaminen Libyan satamien "vaarallisuuteen" on tietysti teatteria.

Tilaston mukaan hukkuneita on peräti 3 % ylityksessä onnistuneihin huijareihin nähden. Mikään satama ei voi olla yhtä vaarallinen.

EU initiatives are credited with dramatically reducing the number of migrants and refugees reaching and attempting to reach Europe by sea from Libya on one of the world's deadliest migration routes. But Libyan officials say factors within Libya played a greater role, and are calling on the EU to honour pledges of support while warning of a busier summer ahead.

But seven years after the 2011 NATO-led intervention that ousted longtime ruler Muammar Gaddafi and ushered in a period of enduring instability and civil conflicts in Libya, Coast Guard officials here see a very different picture.

Under-resourced and overwhelmed, they accuse the EU of failing to provide enough support and predict any success in reducing arrivals to Europe will be short-lived as it is more down to changing local factors than EU policy-making.

"We've had endless meetings with EU representatives since 2011, and they claim to understand our position and make many promises," General Ayoub Ghassem, the spokesman for the Libyan naval Coast Guard, told IRIN in a recent interview at Tripoli's naval base. "But the reality, in the field, is that we find nothing, and virtually no implementation of promises."

Much of the EU's collaboration with Libya comes under Operation Sophia. Launched in 2015 to neutralise smuggling routes in the Mediterranean, the EU broadened the military operation's mandate in 2016 to include training the Libyan Coast Guard and Navy and, later, enforcing a UN arms embargo – it was extended again in 2017.

Repeated requests to temporarily lift the UN arms embargo – imposed to help prevent the general security situation in Libya from deteriorating further – so equipment could be delivered to the Libyan Navy have been rejected. Ghassem said this renders the Coast Guard virtually powerless.

"Although they say the arms embargo is to protect the Libyan nation, we are starting to see it as an act of aggression towards the Libyan people, not for our protection, because the militias have weapons while the official forces have none," the general explained.

According to the EU, the decision to build up the capacity of the Libyan Coast Guard is aimed at disrupting smuggling and trafficking activities, search-and-rescue, and improving overall security in Libyan territorial waters.

But Libya's marine security forces say there has been no such EU support, leaving them ill-equipped to secure 1,900 kilometres of coastline and undertaking rescue operations with a mismatched fleet of loaned patrol ships, aging naval vessels that consume large quantities of fuel, and rigid inflatable boats.

None of these vessels are suitable for the job in hand and many are smaller than the dinghies the smugglers use to send migrants out to sea. The Libyan authorities also lack the safety equipment carried by NGO rescue ships: for example, navy personnel don't have life-jackets, only ropes and a couple of lifebelts to throw to migrant boats and those in distress.

People-smuggling from Libya steadily increased after 2013, as security deteriorated throughout the country and the value of the Libyan dinar on the black market plummeted, wreaking havoc on the economy. The smugglers have grown in strength and aggression and are now heavily armed, often with personal militias, and boast more firepower than official Libyan security forces.

"There are still very large numbers of migrants coming from the south, all planning to cross the Mediterranean, and there is nothing in place to stop them," said Brigadier-General Tarek Shanboor, commander of GACS, the Libyan military authority responsible for coastal security and which reports to the ministry of the interior.

"The smugglers will help them, and our maritime security forces have no weapons so can't even get close to them," said Shanboor. "Criminals and smugglers are increasing, confident in the knowledge that official Libyan institutions have no weapons or power to intervene."

"When a big boat sinks, everybody comes here asking us what we've done to stop migration, and we keep telling them our shortages of equipment prevent us from doing our job properly, but still they give us nothing. It is as if the EU has promised to give us a spaceship, but only once we've reached the moon."

In the midst of an ongoing civil war with ever-changing battle lines, neither the UN-backed Government of National Accord (GNA) in Tripoli nor the democratically elected institutions in eastern Libya has control over all the territory where smugglers operate, nor over all the coastal areas from which the overcrowded and typically flimsy vessels depart across the Mediterranean.

Days after the EU summit, the African Union rejected hosting such centres and decided to set up its own AU migration body to coordinate policies across the continent, amid rising opposition from countries like Libya and Morocco to "counterproductive" EU solutions.

Although part of Operation Sophia's mandate was to disrupt smuggler networks, that has not happened, primarily because its scope is almost exclusively outside the country and its territorial waters. A 2017 UK parliamentary report, Operation Sophia: a failed mission, highlighted this and other failings. A naval mission, the report stated, is "the wrong tool to tackle irregular migration that begins onshore".

The large EU naval presence – soon followed by a flotilla of NGO rescue ships – has also had some unintended consequences. Instead of stemming the outward flow, it initially spurred migrants and refugees on towards the coast. Libyan officials claim it encouraged thousands of additional migrants and refugees to brave the sea journey, believing a fleet of European vessels was waiting to save them.

While the EU says Operation Sophia has now reduced the numbers departing and the deaths at sea, the actual proportion of those who do attempt the voyage but end up dying has seen a recent increase.

"It's true that sometimes our Navy guys use a rope or stick to threaten the migrants, but this is just to scare them into being quiet while we try to complete the rescue," he said. Coast Guard staff are not allowed to carry guns, he added, explaining that five or six officers often have to control large numbers of terrified and panicking migrants who, because they don't want to be returned to Libya, often try to overpower them.

He showed IRIN jumpy video footage of a botched rescue attempt from November 2017, when the NGO rescue vessel Sea Watch attempted to take over an operation already underway by the Libyan Coastguard and then issued a press release blaming everything on the Libyans.

Some Coast Guard staff have been implicated in people-smuggling, with migrants who had returned to Sierra Leone telling IRIN that the same people who put them to sea later captured and imprisoned them.

While millions of euros are being poured into NGO-led migrant assistance in Libya, hardly any funding or support is being directed towards Libya's official maritime security institutions, Ghassem complained. He rubbished media claims that the EU had channelled £160 million into supporting the Libyan Coast Guard, saying that if the UN-backed GNA government had received such funds none had trickled down to them.

Shanboor had a similar story. "We work with the Italians and the EU but, until this moment, we have received nothing except training and the maintenance of... our own boats," he said. "This is the reality of what it's like for us working with the EU."

Noting that GACS had been completely disempowered after 2011, losing most of its fleet, equipment, and its coastal headquarters, which remains occupied by a militia, he added: "We asked countries that participated in the destruction of Libya in 2011 to participate in rebuilding what they destroyed, but I'm sorry to say that they've virtually turned their backs on us."

The EU has trained just 201 Libyan Coast Guard personnel, a modest figure considering GACS alone has 4,500 staff.

Several Libyan officials said the training was too heavily focused on human rights issues rather than more useful instruction on things like the limited communications equipment – during rescue operations most Coast Guard personnel have to rely on their own mobile phones, which have little or no network coverage at sea.

"Many things are more important than training, like actual practical support," complained one of the most senior officials in Libya's Anti-Illegal Immigration Authority, or AIIA, speaking on condition of anonymity.

"The war in Sebha is one of the main reasons for the decrease in migrants arriving in Europe," the head of a migrant detention centre near Tripoli's airport, Captain Wajidi al-Bashir al-Montassir, told IRIN.

Major Mohammed Tamimi, commander of a key checkpoint just north of Sebha, confirmed that fighting in Sebha left smugglers unable to use their usual routes. Before it erupted, smugglers operated openly under the watch of security forces, with seven to 10 large vehicles packed with migrants passing his checkpoint most days. With few weapons and no functioning detention centres in the south, his forces have been powerless to intercept the vehicles for several years.

"Just 200 metres from my checkpoint, there's a smugglers' centre where they gather migrants for the next stage of their journey, but we can't go near them because they are very well armed," he said. "We just watch them, but can do nothing."

Summer numbers set to rise

With the impact of the Sabrata bust, now eight months old, fading and the Sebha route starting up again after an uneasy truce was reached in early May, Libyan officials believe the number of migrants and asylum seekers making their way to the coast will rise again soon.
