Leviäminen

1800-luvulla länsimainen oikeusjärjestelmä oli hallitseva myös siirtomaina olevissa muslimimaissa. Vasta 1900 luvun radikalisoituminen mahdollisti sharian paluun. Alla eri lähteistä kerättyjä shariaan eri asteiden käyttöönootto vuosia muslimimaissa.

Usein sharia on ollut siviili ja avioliitto oikeutena, kun rikoslakina on toiminut brittiläinen tai ranskalainen oikeusjärjestelmä.

Sharia ei siis ole aina ollut muslimimaissa kaiken kattavan laki järjestelmänä ja mm. Turkki on täysin luopunut shariasta.

In the 19th century, many Muslim countries came under the control or influence of Western colonial powers. As a result, Western-style laws, courts, and punishments began to appear within the Sharia. Some countries like Turkey totally abandoned the Sharia and adopted new law codes based on European systems. Most Muslim countries put the government in charge of prosecuting and punishing criminal acts. In the area of family law, many countries prohibited polygamy and divorce by the husband's repudiation of his wife.
Modern legislation along with Muslim legal scholars who are attempting to relate the will of Allah to the 20th century have reopened the door to interpreting the Sharia. This has happened even in highly traditional Saudi Arabia, where Islam began.
Since 1980, some countries with fundamentalist Islamic regimes like Iran have attempted to reverse the trend of westernization and return to the classic Sharia. But most Muslim legal scholars today believe that the Sharia can be adapted to modern conditions without abandoning the spirit of Islamic law or its religious foundations. Even in countries like Iran and Saudi Arabia, the Sharia is creatively adapted to new circumstances.

Libya 1977
The intention of reestablishing sharia was announced, and Qadhafi personally assumed chairmanship of a commission to study the problems involved. In November 1973, a new legal code was issued that revised the entire Libyan judicial system to conform to the sharia, and in 1977 the General People's Congress (GPC—see Glossary) issued a statement that all future legal codes would be based on the Quran.

Nigerian human rights group debates Sharia law
A Nigerian human rights group is to appeal against an Islamic court's decision to close down its Twitter and Facebook sites.

The Civil Rights Congress of Nigeria uses the website chat forums to discuss Nigeria's strict Sharia legislation. The group says the legislation mainly affects the poor while politicians steal millions with impunity.

The case was brought to court by an Islamic organisation, the Association of the Muslim Brotherhood of Nigeria, which aims to stamp out the internet debate about Sharia. The debate was triggered by the ten-year anniversary of the first sentence given by a Nigerian Sharia court: in March 2000 a peasant farmer's hand was amputated for stealing a cow.

Sharia law is currently in force in 12 of the Nigeria's 36 federal states, alongside the usual legal system. People can choose between the two systems. Sharia courts mainly deal with cases such as petty theft and divorce.

Bill limiting sharia law is motivated by 'concern for Muslim women'

Lady Cox, the proposer, says aim is to prevent discrimination against Muslim women and 'jurisdiction creep' in Islamic tribunals

Islamic courts would be forced to acknowledge the primacy of English law under a bill being introduced in the House of Lords.

The bill, proposed by Lady Cox and backed by women's rights groups and the National Secular Society, was drawn up because of "deep concerns" that Muslim women are suffering discrimination within closed sharia law councils.

The Arbitration and Mediation Services (Equality) Bill will introduce an offence carrying a five-year jail sentence for anyone falsely claiming or implying that sharia courts or councils have legal jurisdiction over family or criminal law. The bill, which will apply to all arbitration tribunals if passed, aims to tackle discrimination, which its supporters say is inherent in the courts, by banning the sharia practice of giving woman's testimony only half the weight of men's.

Cox said: "Equality under the law is a core value of British justice. My bill seeks to preserve that standard"

The Christian peer Caroline Cox has waded into controversy again and angered some Muslims, particularly the Sharia Council of Britain, by tabling a bill that claims to address concerns regarding sharia arbitration in Britain. The baroness (the same who extended an invitation to Geert Wilders in 2010) says: "If we don't do something, we are condoning it." The "it" here is the alleged violation by sharia courts of legal parameters that limit them to ruling only in civil cases.

Dutch law goes before Islamic law

Dutch courts sometimes conform to the legal rules of other countries, but they are always watching for violations of the Dutch legal system and of human rights. Dutch laws always take precedence, Deputy Justice Minister Fred Teeven said on Thursday.

Mr Teeven spoke in response to questions from Geert Wilders' Freedom Party about the influence of Islamic law or Sharia on sentences passed in the Netherlands. According to the deputy minister, the relationship between the two is "negligible."

MPs from the Labour, Socialist and Green Left parties expressed unease that the Freedom Party would suggest a link between Sharia and Dutch law. "You are trying to frighten people with myths, to incite them against something that does not exist," said Labour MP Martijn van Dam.

Sanomalehti Trouwin mukaan Haagin Schilderswijkin alue on ortodoksimuslimien hallinnassa. Ortodoksimuslimit määrittävät sen miten alueella pukeudutaan ja käyttäydytään, tosin poliisin ja paikallispoliitikkojen mukaan väittämä ei pidä paikkaansa.

Police, locals deny claim part of The Hague is a 'Sharia triangle'

Claims by newspaper Trouw that part of The Hague's Schilderswijk district is so dominated by orthodox Muslims they are dictating what people should wear and how they should behave, have been denied by both police and local politicians.

Under the headline 'Hague district is orthodox Muslim territory', Trouw said 'short skirts and dresses are not accepted on the street'.

The paper said the area, with a population of some 5,000, is known by locals as 'The Sharia Triangle'. 'Very slowly, the rules in the area are beginning to change,' the article said. 'The norms of the majority are beginning to take over.'

But locals were quick to describe the article as exaggerated. 'We know the area is dominated by Muslims, yes,' said local Christian Democrat leader Gert-Jan Bakker. 'But we have never noticed they are in control.'

Local police chief Michel de Roos told broadcaster Omroep West claims by Trouw that the police allow locals to solve their own problems is not true. The police presence in the area has been strengthened and local beat officers have a strong local network, he said.

'We have had no indications there is a sort of sharia police,' he said. 'That is not to say it does not happen, but we are unaware of it.'
