EU:n ja Hollannin valtion jatkuvista toimista huolimatta laitonmaahanmuutto rehottaa.

EU:n sisään pääsee esim. turistiviisumilla, tämän jälkeen voi kadota vaikka toiseen maahan. Hollannissa on töitä tarjoalla henkilöille jotka eivät osaa edes hollantia tai englantia ja laittomat maahanmuuttajat auttavat toinen toistaan.

Laittoman maahanmuuttajan työllistämisestä tulee 8000 euron sakot yrityksillä ja 4000 euron yksityisille. Kuitenkin kiinnijäämisen riski on pieni, verrattuna laittomista työntekijöistä saatavaan hyötyyn.

Vuosina 2005 - 2006 arvioitiin Hollannissa olevan 74 000 - 184 000 laitontasiirtolaista.

Tammi-lokakuussa Hollannin valtio maksoi 2 165 palautettavan matkat. Suurimmat ryhmät olivat irakilaiset 629 ja brazilialaiset 263.

Hollannissa on arviolta 45 000 - 120 000 laitonta siirtolaista. Yksin Rotterdamissa on arviolta 15 000 - 20 000 laitonta siirtolaista.

Ensi kuussa Hollannin parlamentti äänestää uudesta ulkomaalaislaista. Lain mukaan minkätahansa pituinen laittomat oleskelu Hollannissa vaarantaa oikuden oleskelulupaan.

Suurimpien kaupunkien pormestarit pelkäävät nyt, että uusi laki vaarantaa kaikista heikoimmassa asemassa olevien laittomien siirtolaisten aseman.

Vuonna 2009 Hollannissa havaittiin 25% enemmän laittomia työntekijöitä kuin vuotta aikaisemmin.

1/3 laittomista on Bulgariasta tai Romaniasta, joista tulevat tarvitsevat Hollannissa työluvat vaikka ovatkin EU:ssa.

Yleisimpiä aloja laittomalletyönteolle ovat rakennus-, siivous- ja ravintola-alat.

Labour inspectors found 2,500 workers without permits in spot checks on companies last year, a 25% increase on 2008, Nos tv reports on Tuesday, quoting from the inspectorate's annual report.

Almost one third came from Bulgaria and Romania, Nos said. Even though both countries are members of the EU, their nationals still need permits to work in the Netherlands.

The rise in illegal employment was strongest in the construction sector. According to social affairs minister Piet Hein Donner, this is because the sector has been hard hit by the economic crisis and employers are trying to cut costs, Nos said.

Fines

Cleaning companies and the catering trade also employ a lot of illegal labour.

Inspectors handed out fines totalling €26.5m to companies with illegal staff and almost €950,000 to firms breaking minimum wage laws.

The report also showed 76 people were killed in work-related accidents last year. Some 25% of serious accidents involved building companies, Nos said.

THE HAGUE, Thursday - Labour (PvdA) leader Diederik Samsom has guaranteed that illegal residence in the Netherlands will become an offence. At the same time, the PvdA members are threatening to put forward a motion against this plan.

That illegal residence should become an offence was agreed by the conservatives (VVD) and PvdA in the coalition accord. Recently, much opposition has arisen within the PvdA against the proposal, but Samsom and VVD parliamentary leader Zijlstra said in an interview on Wednesday's TV programme Nieuwsuur that this will go ahead as planned.

A motion will be put forward at a PvdA party congress this Saturday to vote against the coalition agreement. This motion comes from the PvdA branches in Amsterdam, The Hague, Tilburg and Eindhoven.

If the motion is adopted, Samsom will either have to snub his own grassroots or the VVD. In the latter case, this would spark a cabinet crisis.

Samsom appears to be opting for the agreements with the VVD. At the congress in Leeuwarden, there will be "room to debate," but the agreement in the coalition accord will stand, as far as he is concerned. The PvdA leader does say that help given to illegals, such as the provision of accommodation, will not become an offence.

Under the previous cabinet, the PvdA strongly opposed the planned criminalisation of illegal residence. A motion from The Hague branch to be put forward Saturday states that "great damage will be done to the credibility of our party if we renounce our principles, values and ideals s social democrats by cooperating on the criminalisation of illegal residence."

According to the plan, illegals can be fined or ultimately put in prison for the sole fact that they are in the Netherlands without permission.

PvdA chairman Hans Spekman - as an MP, an opponent of criminalisation - is not planning to bow to the increasing pressure. "We stand for this agreement from the coalition accord," said the executive in voting advice to the congress.

Upon recommendation by State Secretary Teeven of Security and Justice, the Council of Ministers has agreed to submit a proposal to the House of Representatives to amend the Aliens Act in such a way that foreign nationals who reside illegally in the Netherlands are guilty of a criminal offence. Foreign nationals who reside in the Netherlands illegally commit a criminal offence that is subject to the sanction of a fine. Imprisonment for nonpayment of a fine is possible if the fine is not paid.

Foreign nationals who are fined twice (or more often) because they reside illegally in the Netherlands risk a severe entry ban. The term of a severe entry ban is at most five years.

Making illegal residence in the Netherlands liable to punishment means that it becomes less attractive to do so. This has a deterrent effect. Moreover, it gives a clear signal to foreign nationals who reside in the Netherlands illegally: from now on they are committing a criminal offence.

The criminalisation applies exclusively to adult foreign nationals. If the foreign national still has a term for voluntary departure (at most 28 days), the criminalisation does not apply.

Persons who aid illegal foreign nationals for humanitarian reasons will not be guilty of an offence. Employers and malafide landlords who employ or offer accommodation to illegal foreign nationals will remain liable to punishment. They will be dealt with more severely.

First and foremost, foreign nationals who reside here illegally have to leave, preferably voluntarily, but if necessary will undergo forced (repatriation). Criminalising illegal residence may not lead to delays in or obstacles to said departure. In other words: departure prevails over punishment.

The European Court of Justice determined on 6 December 2012 (Sagor judgment) that the EU Member States are competent to criminalise illegal residence subject to the sanction of a fine. Imprisonment for nonpayment of a fine is also permitted, according to the Court, provided that it is guaranteed that this punishment is cancelled as soon as the foreign national can be removed. The legislative proposal contains such a provision and therefore complies with the conditions imposed by the highest European court on the criminalisation of illegal residence.

Syksyllä 2012 maan hallitus ilmoitti aikeistaan tehdä paperittomana maassa oleskelusta rikoksen, johon syyllistyvä voidaan tuomita neljäksi kuukaudeksi vankeuteen tai 3800 euron sakkoihin.
Maassa arvioidaan olevan 45 000–150 000 paperitonta.
