Sham marriage boom after judges rule Home Office crackdown is illegal

Sham marriages are booming after judges relaxed laws designed to prevent them, figures show.

The number of illegal immigrants who stage fake ceremonies to stay in the country are likely to top 500 this year, the highest level since 2004.

The 3,578 sham marriages in 2004 fell to 282 in 2006. But after the restrictions were abandoned in the wake of the 2008 Lords decision, they have climbed by 80 per cent.

Rise in sham marriages to beat UK immigration laws
The number of suspected sham marriages by illegal immigrants has leapt by more than half in the past year.

Home Office figures for 2009 show a 54% jump, with 529 suspected cases reported by registrars in England and Wales.

The leap comes after the Law Lords overturned a government scheme designed to stop illegal immigrants marrying.

Registrars have told the BBC that marriage rackets are using Eastern European brides to provide other migrants with a toehold in the UK.

The scale of the problem has been highlighted in a special BBC investigation in which a reporter posed as an illegal immigrant - and quickly found people offering to help him marry.

Ei mitkään unelma häät: Tsekkiläinen morsian ja pakistanilainen sulhanen toimitettiin putkaan hää-alttarilta epäiltynä valeavioliiton järjestämisestä.

Valeavioliittojen määrä on kasvanut nopeasti viime vuonna niiden määrä kasvoi 54% edelliseen verrattuna. Kasvun oletetaan johtuvan mm. tiukentuneista maahanmuuttosäännöistä.

Kasvava määrä EU-kansalaisia menee naimisiin ei-EU-kansalaisten kanssa, jotta jälkimmäiset saisivat samat edut kuin Britannian kansalaiset. Viime kuussa pidätettiin puolalainen morsian ja intialainen sulhanen.

Maanantaina tuli voimaan uusi laki. Sen mukaan brittien kanssa naimisiin menevien on läpäistävä englanninkielen koe ennen kuin voivat saada viisumin. Lain tarkoituksena on vähentää avioliittohuijausten määrää.

Laki ei vaikuta EU-kansalaisiin, mutta 40 000 vuosittaiseen maahantulijaan.

Foreign brides to face English tests

Foreign brides and grooms will have to prove they can speak English before being allowed to move to the UK under new rules which come in to force on Monday.

Migrants wanting to marry a Briton or other UK resident will have to pass a basic English test before they are handed a visa in bid to promote integration and crack down on sham marriages.

But the new rule will discriminate against British citizens because EU laws mean other Europeans living here can bring in a foreign partner from anywhere in the world without having to pass the test.

This is because the spouse of an EU citizen is automatically given the same right to free movement under the European Union's rules.
