German-born criminal to be deported to Turkey

A German-born Turkish man with a string of criminal convictions can be deported to Turkey, even though he has never lived there and only speaks broken Turkish, a court has ruled.

The legal fight between the city of Munich and the 22-year-old man was decided on by the Bavarian Administrative Court on Friday, which ruled he can be expelled from Germany.

The man could be expected to continue to commit crimes, the judge ruled. And although his deportation is a massive encroachment on his 'personal, economic and social relationships', it can be undertaken in the German public interest.

The man first came to the attention of the authorities when he was just 11, after missing school and then beating up his classmates. In April 2005 he was first jailed on two counts of grievous bodily harm and a sexual offence. Further convictions followed, of violence, making threats, theft and possession of drugs.

He was sentenced to two years and nine months in prison, where he seemed to flourish, completing his school certificate and starting a carpentry course. But when he was released in February 2007, he again went off the rails, the court heard, failing to meet his probation officer, and taking drugs. In July 2008 he was again convicted of causing grievous bodily harm and has been in prison since this April.

The court decided that the man could be deported to Turkey, with the judge noting that he spoke broken Turkish and saying he was not 'integrated' into society.

Mutta mikä velvollisuus turkilla on vastaanottaa muun maan rikollisia kansalaisia?

Tuollaisille pitäisi antaa kaksi vaihtoehtoa: a) joko istut muumimamman syliin, tai b) lähdet maasta. Jossain vaiheessa ne alkavat pitää reiluna sitä, että on toinenkin vaihtoehto kuin sähkötuoli. Samalla loppuun vinkuminen epäreilusta ja epäinhimillisestä kohtelusta.

Mutta mikä velvollisuus turkilla on vastaanottaa muun maan rikollisia kansalaisia?

Eihän hän ole Saksan kansalainen vaan Turkin kansalainen. Saksan kansalaisuuslaki tyyppiä jus sanguinis ja käsittääkseni vielä enemmän kuin Suomen laki, jossa on periaatteesta käsittääkseni lipsuttu jus solin suuntaan.

Sus sanguinis eli s.o. veren oikeus tarkoittaa, että kansallisuus periytyy vanhemmilta. Jus solissa taas syntymäpaikka ratkaisee. Maat jakaantuvat jompaan kumpaan tyyppiin, joskin yleensä laeissa on vaikutteita myös toisesta tyypistä esim. siksi ettei kukaan jäisi ilman kansalaisuutta. USA on tyypillinen "jus soli"-valtio. Jokainen USA:ssa syntynyt saa maan kansalaisuuden (pl. diplomaattien lapset)

Loistavaa. Vierasta rikollista ainesta ei tarvitse maassa hyysätä sillä tekosyyllä, että rikollinen on sattunut syntymään ko. maassa. Tästä vain mallia koko Eurooppaan ja karkotuksia toimeenpanemaan sadoin tuhansin rikollisille. Ehkä jäljelle jäävät miettivät kaksi kertaa ennenkuin purevat ruokkijansa kättä.

Ja ihmisoikeusulisijat voisivat kerrankin ajatella myös isäntämaan kansalaisten oikeuksia ja rikosten uhrien oikeuksia, ei vain ryöstäjien ja raiskaajien "oikeuksia".

Mohammad Eke was born and grew up in the German city of Essen. Until authorities found out that his parents had entered the country illegally, Germany was his home. Then Eke was deported to Turkey, even though he'd never visited the country and didn't speak the language. It's just another run-of-the-mill case of German immigration policy in action.

In October 2002, German officials refused to extend Eke's residence permit, which meant that he was now legally required to leave the country, as were his parents and siblings. The first attempt to deport the family came in April 2005. It failed, because the parents weren't home that day; instead, they were at a family gathering in Bremen. After that, the father disappeared for several months. The mother was overwhelmed, and the immigration office obtained a court order to appoint a guardian for her six underage children. The authorities were closing in.

Mohammed Eke led most of his life believing he was a Lebanese refugee, as his parents had told him, and a German. Indeed, he had been born in Germany and spoke German much better than Arabic. Then, he learned about "the lie": His parents were actually from a region in Turkey where Arabic was spoken and had lied to authorities when they immigrated to Germany as refugees. In the eyes of the German authorities, he was neither German nor a legal resident of Germany.
